Conditions for Exemption of Iranian Subjects who live abroad
Iranian subjects who live abroad in case of having the following conditions, by paying 10 million Toman can benefit from military services exemption against cash payment.
1- They must have been exited the country before 1382/12/29.
2- They must have lived at least 2 years in the foreign country.
3- They must live at least 9 months in the foreign country in each stage.
Some Important Notes
1- The bases for calculating the two-year residency abroad the country will be subjected after the age of 13.
2- Those subjects who entered the country at least three years before the subjections age from the first notification of the above mentioned provisions (1382/11/4), are considered in these provisions, however those who entered the country before the mentioned date (1382/11/4) and under subjections age, do not consider in these provisions.
3- Residency in a foreign country must be confirmed by Islamic Republic of Irans representatives (Embassy or Consulates) in the residency country and after that it must also be verified by the Foreign Ministry (Iranian States Office).
4- The above mentioned exemption is not applicable for those subjects who have escaped from military service, unless their escapes crime have been investigated and settled.
Required Documents
1- Residency Certificate for at least two years of living abroad the country
2- Three pieces of colored 2*3 photo in full face by complete white background that the subjects properties have been written behind it
3- Two versions of verified copy of subjects birth certificate (If there are ay description, all pages must be copied)
4- If the exemption process is investigating by the subjects legal attorney, the original power of attorney, the original and copy of birth certificate of the attorney must also be presented.
5- The last academic degrees certificate (In cases when he degree is obtained outside of the country, the official translation must also be presented).
6- Copy of National ID Card
7- The verified copy of the original passport or subjects passport by which he/she has transferred.
8- Paying related fees and presenting its receipt
Stages for Investigating the Substitution Exemptions Request of Iranian Subjects Who Live Abroad
1- Subjects referring to Islamic republic of Irans representatives in the residency place or the nearest representative outside of the country
2- Completing related forms and presenting the requested degree to the representative
3- Sending all documents thorough representatives office to the Foreign Ministry of Islamic Republic of Iran
4- Confirmation of the third row of documents by the Foreign Ministry and sending them to NAJA Military Service Organization
5- Investigating the documents, completing the case and referring it to Investigation Association
6- Paying the related costs for issuing the exemptions card and its delivery to the subject. Those who do not have the required conditions for substitution exemption, the military service dispatching sheet will be issued for them.
Conditions for Qualifying Substitution Exemption
Those who have one of the following conditions can benefit from substitution exemption:
1- Father at the age of more than 59
2- Father at the age of less than 59, but requiring care
3- Mother without husband
4- Grandfather without male or female children and requiring care (father of father or mother)
5- Grandmother without husband and male or female children (mother of father or mother)
6- Brother at the age of more than 18, without father, wife, and children and requiring care
7- Sister at the age of more than 18, without father, husband, and children and requiring care
8- Single sister without father
9- Underage brother or sister
10- Overall constitution of supporting disabled people
The steps for investigating the claim of the subjects sickness or his relatives sickness outside of the country (Medical Exemption): Investigating the medical exemption of subjects or declaring the idea about the sickness of subjects relatives, is being performed by the Medical Council of public services units inside of the country, however in order to facilitate the steps of investigating the medical exemption of Iranian subjects who live outside of the country and prevent unnecessary travels which waste time and costs, it has been settled with performed cooperation with related references that these states will be performed in Islamic Republic of Irans representatives outside of the country. All necessary programming has been performed for justifying defined doctors and their process would be as follow after related cooperation:
1- The reference of the subject to Islamic Republic of Irans representative in the place of residency or the nearest representative outside of the country.
2- Filling the related forms and presenting the required documents to the representative
3- Paying the related costs
4- Making an appointment for the subject to take participate in the meeting of medical examination of the representative
5- Receiving the professional idea form the predetermined hospital outside of the country and take participate in the meeting of predetermined doctors (If necessary)
6- Conducting the idea concerning the physical condition and sickness of the subject or his relatives by the confirmation of the representative
7- Sending all documents via the representative to the Ministry of Foreign Affairs
8- Confirming and sending the above mentioned documents via the Ministry of Foreign Affairs to the NAJA Public Service organization
9- Investigating and opening the case in the medical council of the Great Tehrans public service center and issuing the verdict
10- Declaring the verdict result of the medical council to the Ministry of Foreign Affairs or the subjects legal attorney in order to pay the considered costs
11- Issuing the exemption card and delivering it to the Ministry of Foreign Affairs or the subjects legal attorney.
In case of the negative verdict of the medical council, the departing paper will be issued for the subject and it will be delivered to the Ministry of Foreign Affairs or the subjects legal attorney.
The Steps of Investigating the Student Exemptions Request of Subjects who live Outside of the Country
1- Receiving the studying certificate from the school and its confirmation as the related form of the Ministry of Foreign Affairs and the center of International Affairs and Foreign Schools (related to Iran Ministry of Education) and presenting the mentioned documents to the NAJA Military Service Organization
2- Issuing the student educational exemption for the subject and presenting it to the center of International Affairs and through it to the passport police for subjects transmission into the country
The Steps of Investigating the University Student Exemptions Request of Subjects who live Outside of the Country
1- Receiving the studying certificate from the university and its confirmation as the related form of the Ministry of Sciences, Researches and Technology or the Ministry of Health, Treatment and Medical Education and presenting the mentioned documents to the NAJA Military Service Organization
2- Issuing the student educational exemption and presenting it to the mentioned ministries and through it to the passport police for subjects transmission into the country
Explanation: According to the article of 21 of the executional law of the part of the educational exemption of the military services constitution, those subjects who are succeeded to receive the diploma degree outside of the country, can use the educational exemption till Ph.D. degree in cases where they have been educated or will be educated in the fields which are confirmed by the Ministry of Sciences, Research and Technology or the Ministry of Health, Treatment and the Medical Education and based on the constitutions and laws of these ministries.
Transmission of Iranian Subjects who live Outside of the Country
1- All people who have exited the country before 1382/12/29, can enter the country once a year and maximum for 3 months. Those Iranian subjects who live outside of the country and want to enter the countrys airport in the transit form and their passport will be sealed by the transit seal, have the right to use the transit benefit once a year, too.
2- Those university students who have exited the country till the end of 1385 and are studying in one of the certified universities of the world which are confirmed by the Ministry of Sciences, Research and Technology or the Ministry of Health, can enter the country twice a year and maximum for three total months.
Absent Militarys Subjects
Who are absent subjects?
Based on Military Services regulation and declaration the following people will be considered as absent subjects:
- Military services subjects which have called up for handling or dispatching, and would not introduce themselves in the appointed time announced by Military Service Organization.
- Those who possess temporal exemption and do not introduce themselves at least one month after the end of their exemptions credit.
- Those who have the paper of militarys dispatching and do not introduce themselves in the appointed time.
- Individual diploma and pre-university subjects who do not send their documents of introduction in legal times which are appointed based on their birthday and time of receiving their academic degree.
- Graduated subjects (Associate or upper degrees) if they do not introduce themselves until 6 months after their graduation.
- Relinquishment, dismissed and dropouts students of universities, if they do not introduce themselves until 4 months after the date of relinquishment, dismissing and dropping out.
- Those subjects who continue their study in different academic periods more than allowed limitation.
- Those subjects who continue their study in a free (sundry) way and continue their study after the dispatching appointed legal time.
Note: those subjects, who request for medical or substitution exemption in the legal timeout, and their case is on the process of medical or substitution checking, if they cause the checking stages to be longer in purpose or by default in cases consistency and not presenting in medical council or substitution directors sessions, the dispatch letter will be issued with absence for them in cases when the medical council or substitution directors vote on their being soldiers. In fact this verdict is equivalent to absent subjects.
Peoples Aged Exemptions
Subjects do not pay attention to rumors about increasing age exemptions limitation
NAJA Group – Director of Social office of Police Military Service Organization stated to military services subjects: Only those who born till the end of 1354 are exempted from performing obligatory military service.
By the report of Police News Station, Colonel Farhad Arab added to this news that: Published rumors about increasing the limitation of aged exemption are false and phony.
He declared that: As this organization announced recently, only those who born till the end of 1354 and have under diploma to Bachelor degree can benefit from Rahbars exemption.
Director of Social office of Police Military Service Organization mentioned that: Those who born until the end of 1352 and have Master degree, those who born until the end of 1350 and have non-medical PhD and also those who born until the end of 1344 and has medical PhD or vet can use this type of exemption.
Calling-Up Militarys Subjects to Service
Military Service Organization called up subjects for their service
NAJA Group – Police Military Service Organization called up for diploma and under diploma subjects to military service in Khordad of the present year by issuing an announcement.
By the report of Police Station News, the complete text of Military Service Announcement is as follows:
To the consideration of all subjects who have diploma or under diploma degree (Absent or present) and those who born between 1355 till the end of 1371 who have received NAJA Military Service Organization dispatching letter in the date of 18th and 19th of Khordad, to being called-up for military services.
- In Tehran (Subjects who live in Metropolis Tehran)
All absent and non-absent subjects who have diploma degree and heir dispatching time has been mentioned in NAJA Military Service Organizations Dispatching letter in Khordad of 1390, must present at 6:00 A.M in Wednesday 1390/3/18, and all absent or non-absent subjects (under diploma) at 6:00 A.M. in Thursday 1390/3/19 at centers which have been announced by NAJA Military Service Organization in a Visit Place paper to be dispatched for military services.
- In Provinces (Subjects who live in counties)
All absent and non-absent subjects who have diploma degree and heir dispatching time has been mentioned in NAJA Military Service Organizations Dispatching letter in Khordad of 1390, must present at 7:00 A.M in Wednesday 1390/3/18, and all absent or non-absent subjects (under diploma) at 7:00 A.M. in Thursday 1390/3/19 at the residency provinces Military Service Assistance Office to be dispatched for military services.
Therefore those subjects who did not receive the Visit Place paper until now can refer to the nearest Electronic Police Services Office (Police +10), receive the above mentioned paper and act based on the written information.
Conditions for Reducing Subjects Service Time
Military service duration is still 18 months in 1390. The commander-in-chief Kamali mentioned that: The reduction of service time for subjects who have bachelor degree is one month, those who have master degree two months, and those who have PhD degree is three months. Also those subjects servicing in operational and security areas have two months of reduction, and those servicing in deprived areas which have inappropriate weather have one month.
He added: By the proposal of General Chief of the Armed Forces and the supreme commander of chiefs agreement the deadline for executing veterans and relief seekers provisions have been extended till the end of Esfand of 1390 for one year.
The successor of the general resource office of armed forces has mentioned: Service of subjects who have master or upper degrees can benefit from two months of service reduction based on noticed provisions of the general staff, in case of any research or invention related to armed forces issues or atomic energy.
The commander-in-chief Kamali by mentioning the servicing reduction for bachelor subjects for one month, master subjects for two months, PhD subjects three months and postdoctoral subjects for four months has stated that: non-absent married soldiers will be asked for servicing in their residencys province.
By restating that there is no program for group exemption of absent subjects or their forgiveness, he mentioned that: in 1390, the reaction to those subjects who do not obey the law would be more severe, but if these mentioned people will introduce themselves and behave well during their servicing, there are some arrangements for forgiving their added servicing by their commanders and officials.
The successor of the general resource office of armed forces has mentioned that: The program for correcting some paragraphs of Military Services provisions which has been approved on October of 1998 by Islamic Parliament of Iran is on the waiting phase of the process because of the objection the Guardian Council found in its financial load.
The commander-in-chief Moosa Kamali in in press conference of announcing the last provisions of military service has mentioned that: In past those subjects who had master or upper degrees could benefit from one year of servicings reduction in case of presenting research projects. In the new provision these people can receive their End of service card in case of presenting research projects related to armed forces or atomic energys backgrounds.
He stated mentioning the extension of deadline for veterans and relief-seekers: By the proposal of the general armed forces and the acceptance of the revolution’s leader, the deadline for the execution of veterans and relief-seekers’ constitution has been extended till the end of 1390. Those who have the required conditions can benefit from the facilities of this law by referring to these centers.
Kamali announced the reduction of military service for the records of taking participate in war and added that: In past, those who have 18 months of presence in the war, one of their children could benefit from 18 months of service’s reduction. However in the new law this time has been limited and the maximum time of service’s reduction for warriors is 9 months and for veterans is 8 months. In this way, if a veteran present between 9 to 11 months in the war fields, benefit 3 months of service’s reduction; if present between 12 to 14 months, 3 months of service’s reduction; 15 to 17 months in the war fields, 3 months of service’s reduction; 18 to 20 months in the war fields, 6 months of service’s reduction; and 27 to 29 months of presence, benefit 9 months of service’s reduction.
He continued that: Those veterans who present more than 30 months in the war fields, one of their children will be exempted and in cases that they present 60 months in the war fields, 2 of their children will be exempted. In the new constitution, those veterans with injuries below 15 percent will benefit from facilities according to the percent of their injury.
The substitution of the human forces of the general armed forces by mentioning some changes in the selfless cart constitution, has stated that: The children of those selfless families which have received the card before can cancel their card to make it possible for the families’ another child to use this card, if they had immigrated from their place of living till the end of 89.
By mentioning the issued certificates in 89, he corrected that: If a person has received the certificate of military service’s reduction in Esfand 89, the amount of service’s reduction will be calculate according to the previous year. Also all the certificates which are issued in 88 and 89 are validate and the rules of those who have the certificate will be executed based on the year of issue.
Kamali has declared the time of military service as 18 months and mentioned that: in 1390 the time of military services will not change but at the end of 1390 some professional analysis will be executed in order to change the time of military service , the time may exceeded to 24 months or stay the same 18 months.
The substitution of the human forces of the general armed forces by mentioning the absence of execution of reformation of the military service law’s articles stated that: This law has been approved by the Parliament of Islamic Council in Mehr 1388, but the Guardian Council found some mistakes in its financial load. Then some meetings have been held by the government’s representatives and it has been determined that the plan’s financial load will be reduced 600 Billion Toman in a year. Now we are waiting for the approving this law in the government’s commission.
By rejecting some rumors concerning the forgiveness of absent subjects and their added service, he stated that: Armed forces do not forgive any absent who has added service and it is not regulated in our programs. Those who had absences should perform their military services, although some facilities will be considered for absent subjects, and their added services will be forgiven in case of well-doing the service.
Kamali announced the employment of 500 subjects in the plan of elite’s exemption and enforced that: More than elites, about 300 subjects who have the PhD degree take participate in research projects to benefit from the military service’s exemption. Also subjects who have master degree and upper degrees can benefit from 2 months of reduced service while participating in this project.
By declaring the issuing of Smart Military Service Card, the substitution of the human forces of the general armed forces, mentioned that: Issuing the Military Service and Exemption card has been centralized in the military service organization and no other organization has the right to issue that. In first three months of this year all card will be issued in the smart form, moreover during a calling process, all military service card which are issued after 1354 will be changed to the smart form and through this method those who have imitative card can be legally clashed.
He announced the annual identification of 5 thousand holders of imitative military service cards and mentioned that: Each year different bands will be identified and arrested concerning these issues and that’s while by changing the military service card different people will be identified. Also each year 50 to 60 thousand fugitives and absent soldiers will be arrested by the general armed forces. This year we have a plan for severe contact with fugitive and absent soldiers.
By mentioning the reduction of reduced services of Basiji people, Kamali stated that: In the past Basiji people benefit one year of reduced service however in the new law this amount has reduced to 6 months.
The substitution of the human forces of the general armed forces by declaring the lack of execution of marriage facilitating’s law for soldiers, has stressed that: According to this law, the salary of married soldiers must be twice the single ones, but unfortunately no credit has been attributed to this issue until now and we are following this case from the government. The general armed forces pay an amount of money as the married facility, however it is not impressive.
By rejecting the news of simultaneous education while servicing for soldiers, he said that: All soldiers who enter the armed forces must learn technical-professional and applied learning. Soldiers which decide to continue their study should use the educational exemption. Scientific-applied learning is only available for 3 thousand people who are the members of Basiji or Veterans’ families.
